PUBLIC HEARING NOTICE
Planning Commission/Board of Adjustment
April 25, 2023
The Martin County Planning Commission/Board of Adjustment will be conducting a public hearing on April 25, 2023 at 5:30 p.m. The hearing will be held in the Martin County Commissioners Room, located on the first floor of the Courthouse, 201 Lake Avenue – Fairmont, MN. The following items will be on the agenda:
Conditional Use Permit request from MB Realty LLC (Mike Bettin), applicant and property owner, within Section 28 of Fairmont Township. Mr. Bettin is proposing to operate a commercial self-storage facility in an “HB” Highway Business District. The Martin County Zoning Ordinance requires a Conditional Use Permit in an “HB” Highway Business District for any warehousing operation.
Conditional Use Permit request from Design 1 Architects LLC, applicant, (William Wenzel Trust, property owner), within Section 23 of Lake Belt Township. Design 1 Architects LLC is proposing to construct a 255-foot self-supporting Wireless Communication Tower to improve cellular service in the surrounding area on a site located in an “A” Agricultural District. The Martin County Zoning Ordinance and the Martin County Wireless Communications Ordinance requires a Conditional Use Permit in an “A” Agricultural District for any new tower to a maximum of 400 feet.
Conditional Use Permit request from Northern Natural Gas, applicant, (Allan Kittleson Etal – property owner) within Section 21 of Manyaska Township. Northern Natural Gas would like to construct and operate an in-line inspection device receiver and a maximum allowable operating pressure (MAOP) regulator in an “A” Agricultural District. The Martin County Zoning Ordinance requires a Conditional Use Permit in an “A” Agricultural District for any essential structures and essential service lines.
Variance request from Northern Natural Gas, applicant, (Allan Kittleson Etal – property owner) within Section 21 of Manyaska Township. Northern Natural Gas is proposing to construct a building encroaching closer than the minimum required setback from the centerline of the public right-of-way in an “A” Agricultural District. The Martin County Zoning Ordinance requires a 200-foot setback from the centerline of any public right-of-way for a new building site effective February 17, 2004 and one hundred and thirty (130) feet from the centerline of any public right-of-way for existing building sites constructed before February 17, 2004. Existing building sites cannot further encroach closer than the nearest present building from the centerline of the road provided greater than 130 feet from the centerline in an “A” Agricultural District.
