PUBLIC HEARING NOTICE

Planning Commission/Board of Adjustment

April 26, 2022

 

The Martin County Planning Commission/Board of Adjustment will be conducting a public hearing on April 26, 2022 at 5:30 p.m.  The hearing will be held in the Martin County Commissioners Room, located on the first floor of the Courthouse, 201 Lake Avenue – Fairmont, MN.  The following items will be on the agenda:

 

Conditional Use Permit Request from Dale & Debra Moeller within Section 35 of Fraser Township. Mr. Moeller is proposing to mine gravel and sand in an “A” Agricultural District. The Martin County Zoning Ordinance requires a Conditional Use Permit in an “A” Agricultural District for any mining operation.

 

Variance Request from DK Property LLC (Doug & Diana Kahler, property owners) within Section 35 of Rutland Township.  Mr. & Mrs. Kahler are proposing to install a Solar PV (photovoltaic) system panel array encroaching closer than the minimum required setback to the ordinary high-water level from Center Creek in an “SL-1” Shoreland Special Protection District. The Martin County Zoning Ordinance requires a minimum setback of 200 feet from ordinary high-water level in an “SL-1” Shoreland Special Protection District.

 

Conditional Use Permit Request from Northern Natural Gas, Applicant (Krahmer Inc, Etal – Property Owner) within Section 5 of Rolling Green Township. Northern Natural Gas would like to construct and operate an in-line inspection device launcher in an “A” Agricultural District. The Martin County Zoning Ordinance requires a Conditional Use Permit in an “A” Agricultural District for any essential structures and essential service lines.

 

Conditional Use Permit Request from Northern Natural Gas, Applicant (Jesse & Kristine Odegaard – Property Owners) within Section 7 of Rolling Green Township. Northern Natural Gas would like to construct and operate an in-line inspection device launcher in an “HB” Highway Business District. The Martin County Zoning Ordinance requires a Conditional Use Permit in an “HB” Highway Business District for any essential structures and essential service lines.

 

Variance Request from James Neumann within Section 29 of Silver Lake Township. Mr. Neumann is proposing to construct a deck onto an existing house encroaching closer than the minimum required setback from the sideyard setback in an “SL-2” Shoreland Residential Recreational District. The Martin County Zoning Ordinance requires a minimum setback of 30 feet from the sideyard setback in an “SL-2” Shoreland Residential Recreational District.

 

Variance Request from Larry Bremer within Section 29 of Silver Lake Township.   Mr. Bremer is proposing to construct a house with attached garage encroaching closer than the minimum required setback from the ordinary highwater level on South Silver Lake in an “SL-2” Shoreland Residential Recreational District. The Martin County Zoning Ordinance requires a minimum setback of 100 feet from the ordinary highwater level in an “SL-2” Shoreland Residential Recreational District.
