Public Hearing Notice

PUBLIC HEARING NOTICE

The Martin County Planning Commission/Board of Adjustment will be conducting a public hearing on April 23, 2024 at 5:30 p.m.  The hearing will be held in the Martin County Commissioners Room, located on the first floor of the Courthouse, 201 Lake Avenue – Fairmont, MN.  The following items will be on the agenda:

Variance from Tim Murray from Bravo Zulu House (applicant and property manager), within Section 14 of Nashville Township. Mr. Murray is proposing to a construct an all-military sober home exclusively for 13 veterans. This home will occupy more than the stated occupancy definition of family according to the Martin County Zoning Ordinance. The Martin County Zoning Ordinance defines a family as “an individual, or two or more persons each related by blood, marriage, or adoption living together as a single housekeeping unit, or a group of not more than four (4) persons not so related, maintaining a common household” in an “A” Agricultural District.

Variance Request from Jared Boumeester & Jessica Wiederhoeft within Section 19 of Rolling Green Township.  Mr. Boumeester is proposing to construct a machine shed encroaching closer than the minimum required setback from the centerline of the public right-of-way in an “A” Agricultural District. The Martin County Zoning Ordinance requires a 200-foot setback from the centerline of any public right-of-way for a new building site effective February 17, 2004 and one hundred and thirty (130) feet from the centerline of any public right-of-way for existing building sites constructed before February 17, 2004. Existing building sites cannot further encroach closer than the nearest present building from the centerline of the road provided greater than 130 feet from the centerline in an “A” Agricultural District.

Variance Request from Robert Poush within Section 7 of Silver Lake Township. Mr. Poush is proposing to construct a screen porch onto the existing house which will be located closer than the minimum required setback to the ordinary high-water level of Wilmert Lake in an “SL-2” Residential Recreational District. The Martin County Zoning Ordinance requires a 150-foot setback from the ordinary high-water level in an “SL-2” Residential Recreational District.

Conditional Use Permit Request from FAC Radio (Steven Landsteiner, owner and applicant) within Section 10 of Rolling Green Township.  Mr. Landsteiner is proposing to construct a 198 foot (with antennae) 3-legged pyramid shaped lattice tower on a site located in an “A” Agricultural District. The Martin County Zoning Ordinance and the Martin County Wireless Communications Ordinance requires a Conditional Use Permit in an “A” Agricultural District for any new tower to a maximum of 400 feet.
